Terms & Conditions

This is a plain-language draft covering the essentials of how Shinyshells operates. It has not been reviewed by a lawyer. Before relying on it as your binding terms of service, have it checked by a Portuguese/EU consumer-law solicitor — particularly the liability, cancellation and dispute sections, and the [bracketed] company-registration details below, which need to be filled in with your actual registered business information.

1. Who we are

Shinyshells ("Shinyshells", "we", "us") operates a membership service that connects homeowners and property managers on Madeira, Portugal with independent local workers for urgent home repairs and property maintenance, coordinated primarily over WhatsApp.

2. What Shinyshells is — and isn't

Shinyshells is a marketplace and coordination platform. We vet and onboard the workers on our network, but the workers who carry out repair and maintenance jobs are independent professionals, not Shinyshells employees or agents. Shinyshells is not a party to the repair contract between you and the worker who takes your job, and we don't directly supervise the work performed.

We do our best to match you with a qualified, responsive worker and to follow up on job quality, but we cannot guarantee the outcome of any specific job.

3. Creating an account

You need an account to request jobs. You must provide accurate information when signing up and keep your login credentials secure — you're responsible for activity that happens under your account. You must be at least 18 years old to create an account.

4. Membership plans & billing

Shinyshells offers three membership tiers: Free (one home), Premium (19€/month, up to three homes) and Business (79€/month, up to fifty homes). Current pricing and coverage for each plan is always shown on our pricing page.

Paid plans are billed monthly in advance through our payment processor, Stripe, and renew automatically until cancelled.
You can cancel a paid plan at any time; your membership stays active until the end of the billing period you already paid for, and no partial refunds are issued for the remaining period unless required by law.
We may change plan pricing or features going forward; we'll give existing members reasonable notice before a price change takes effect on their next billing cycle.

5. Urgency fees

Separately from your membership fee, each job carries an urgency fee that depends on how quickly you need work to start (within 6 hours, 4 days, 2 weeks, or 1 month) — the faster the window, the higher the fee. This fee is paid to the worker who completes the job, on top of their normal hourly rate. Free members can request the 6-hour and 4-day windows; paid memberships can request all urgency windows. Current rates are always shown on our pricing page before you confirm a request.

6. Cancellation, refunds & disputes about a job

If you're not satisfied with how a job was completed, contact us at bb@shinyshells.com or over WhatsApp as soon as possible so we can look into it and, where appropriate, arrange for the issue to be fixed or escalate it with the worker. We handle these on a case-by-case basis.

7. Acceptable use

You agree not to use Shinyshells for unlawful purposes, to misrepresent yourself, to harass workers or staff, or to attempt to circumvent the platform to avoid membership or urgency fees for jobs arranged through Shinyshells.

8. Limitation of liability

To the maximum extent permitted by law, Shinyshells is not liable for indirect, incidental or consequential damages arising from use of the service, or for the acts or omissions of independent workers on our network. Nothing in these terms limits liability that cannot be limited under applicable Portuguese or EU consumer-protection law.

9. Changes to these terms

We may update these terms from time to time. If we make material changes, we'll notify active members by email before the changes take effect.

10. Governing law

These terms are governed by the laws of Portugal. Any dispute that can't be resolved directly will be subject to the jurisdiction of the Portuguese courts, without prejudice to any mandatory consumer-protection rights you have in your country of residence.
